Dear Sir,

Kindly refer to our discussion on appointing legal heir of a deceased.

Legal heir:-How to appoint the legal heir and file the ITR of a deceased. We need following documents:-

1. Step 1:
A Register as legal heir. It is mandatory. We need any of following documents:-
a. The legal heir certificate issued by court.
b. The legal heir certificate issued by Local revenue authorities.
c Certificate of surviving family members issued by the local revenue authorities, e g; Municipality, etc. If it is in language other than English then also attach notarize English translated virgin.
d. The registered Will of the deceased person
e. The family pension certificate issued by the State/Central government.
B. After getting any of the above certificate /document following steps needed
a. Login to income tax department efiling portal.
b. Select My Account to register as Representative.
c. Select New Request.
d. Select in Add/Register as representative – “Register yourself on behalf of another person”.
e.Select the category to register as Estate of deceased.
f Register as legal heir
g Fill the following details in deceased information in the registration
h. Attach Documents as follows:
1. Copy of Death Certificate.
2. Copy of the PAN Card of the deceased
3. Self-Attested PAN card Copy of the Legal heir
4. Legal Heir Certificate.
g. After verification, the e-filing administrator either approve or reject with remark. If reject then comply with the remark to get register.
h. Now you can file ITR as legal heir.
I Kindly note that the legal heir is responsible for paying taxes, interest or penalty. But liability of the legal heir is limited to the extent to which the assets he inherited.
